JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One country made loaded pistol and 34 live cartridges are said to have been recovered from conscious possession of the petitioner but petitioner claims his false implication and submits that he was caught on mere suspicion and implicated in this case by the police.

Learned counsel for the petitioner drew my attention towards seizure list and submits that there is ambiguity in respect timing of recovery of so called firearm as well as preparation of the seizure list.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two

No.37628 of 2016 (2) dt.09-09-2016 2/2 sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Lakhisarai in connection with Mednichouki P.S.Case No. 12 of 2016, subject to the condition that one of the sureties must be local and holder of landed property.
