The petitioner apprehends his arrest in a case registered for the offence under Section 366(A)/34 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other co-accused, on the point of pistol, kidnapped minor daughter of the informant.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case and the victim girl is not minor, rather she is 21 years old on the date of occurrence. As a matter of fact, there was love affairs between the victim and coaccused Nitesh Kumar and the victim girl left her house out of her own will and both solemnized marriage in a temple. Petitioner is no where involved in the alleged occurrence and has got clean antecedent.

Considering the aforesaid facts and circumstances, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected. (Prabhat Kumar Singh, J) anay/- U T
