JUSTICE SATYAVRAT VERMA ORAL ORDER 11-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Kasim Bazar P.S. Case No. 121 of 2021, instituted for the offences under Section 30(a), 32 of Bihar Prohibition and Excise (Amendment) Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 07.07.2021, charge-sheet has been submitted and has antecedent of 12 cases and allegation is of recovery of 5 litres of liquor from the house, further it was disclosed by neighbours that the petitioner had kept the liquor in the house.

The learned counsel submits that the house belongs to joint family property, as such, the petitioner was not aware

The learned A.P.P. vehemently opposes the bail application and submits that the petitioner has 12 antecedents. Considering the fact the petitioner is in custody since 07.07.2021, charge-sheet has been submitted and allegation is of recovery of 5 litres of liquor, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-IIcum-Special Judge, Excise Act, Munger, in connection with Kasim Bazar P.S. Case No. 121 of 2021.

The application stands allowed.
