Petitioner is languishing in judicial custody since 24.02.2017 in connection with Mehsi P.S. Case No. 29 of 2017 registered for the offence punishable under Sections 379 and 411/34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that while she withdrew Rs. 24,000/- and was in the market, two persons snatched her bag and tried to flee away, but were caught and from the possession of the petitioner, Rs. 24,000/- was recovered and they could not produce papers regarding the
Patna High Court Cr.Misc. No.36262 of 2017(3) dt.12-09-2017 2/3 motorcycle.
It has been submitted by the learned counsel for the petitioner that he is innocent, has been made accused in Mehsi P.S. Case No. 30 of 2017 for the same occurrence in which he has been granted the privilege of bail by this Court in Cr. Misc. No. 36542 of 2017 on 19.08.2017. He submits that charge-sheet has already been submitted and there is no allegation of tampering with the prosecution witnesses by the petitioner.
However, learned A.P.P. for the State opposes the prayer for bail and submits that cash of Rs. 24,000/- was recovered from the petitioner.
Considering the facts and circumstances and the materials on record as well as the period of custody, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, East Champaran, Motihari in connection with Mehsi P.S. Case No. 29 of 2017, subject to the condition that one of the bailors would be a close
