Petitioner is in custody in connection with Excise Case No. 484 of 2019 arising out of Singheshwar P.S. Case No. 74 of 2019 for the offence under section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that petitioner has no criminal.

Learned counsel for the petitioner submits that in the instant case there is recovery of total 30 liters of country made liquor. He further submits that petitioner is in custody since 2.7.2019.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner,

No.51922 of 2019(2) dt.22-08-2019 2/2 let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Excise Act, Madhepura, in connection with Excise Case No. 484 of 2019 arising out of Singheshwar P.S. Case No. 74 of 2019 subject to the condition that petitioner shall deposit Rs. 25,000/- (Twenty Five Thousand) cash in the court below which shall be abide by final outcome of the pending criminal case i.e. in the event of acquittal the amount shall be refunded to the petitioner otherwise the amount shall be forfeited.
