The petitioner seeks regular bail in connection with Budha Colony P.S.Case No.175 of 2017 Special Case No.2053 of 2017 registered for offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 700 ltrs of Tadi.

Submission of the learned counsel for the petitioner is that the petitioner is accused in one more case. He is in custody since 29.6.2017.

Having heard both sides and in view of the allegation, this application is disposed of with direction to the learned trial

Patna High Court Cr.Misc. No.46296 of 2017 (2) dt.19-09-2017 court that once the charge is framed in this case or the petitioner completes five months judicial custody, whichever is earlier, he shall release the petitioner in connection with Budha Colony P.S.Case No.175 of 2017 Special Case No.2053 of 2017 to his own satisfaction.
