In the background of existing animosity amongst the parties, it has been alleged that all the accused persons, so named including the petitioner, made house trespass and out of them, Raj Kumar Sahani caught hold husband of informant namely Ram Sahay Sahani, Shankar Sahani gave Farsa blow while Pramod Sahani gave rod blow. Yogendra Sahani rushed in rescue, who was apprehended by the petitioner, Rameshwar Sahani and was assaulted by Tribhuan Sahani with iron rod. Jitendra Sahani, Shankar Sahani, Jot Narayan Sahani have also assaulted. Ram Sahay Sahani died during midst of way while Yogendra Sahani was being treated.

Admittedly, petitioner is not an assailant either of

Accordingly, petitioner, Rameshwar Sahani is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Raj Kumar-IV, Judicial Magistrate, 1st Class, East Champaran at Motihari/ successor in office in connection with Pipra Kothi P. S. Case no.139 of 2013. (Aditya Kumar Trivedi, J) Vikash/- U T
