This is an application for grant of regular bail for offence under Section 414 of the Indian Penal Code. The prosecution case is that the petitioner was apprehended by the police with other co-accused when they were trying to flee away on the motorcycle.

It is contended on behalf of the petitioner that the similarly situated co-accused has been granted bail in Cr. Misc. No. 32344 of 2016 by a coordinate Bench of this Court. Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Mashrakh P.S. Case No. 173 of 2016 to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra.
