The petitioner is in custody in connection with Agion Bazar P.S. Case No. 24 of 2019 for the offence under Section 30 (a) of Bihar Prohibition & Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case, six persons were named in the FIR along with five unknown persons and total 5049 ltrs of liquor was seized. The petitioner is in custody since 05.07.2019.

Considering the fact that the petitioner has no criminal antecedent and having regard to the quantity of liquor seized, the Court is inclined to grant bail to the petitioner subject to cash deposit of Rs. 1,00,000/- (One Lakh) in the Court below

Patna High Court CR. MISC. No.53025 of 2019(2) dt.29-08-2019 2/2 and on deposit of the same, the Court below shall release the petitioner, above named, on bail on furnishing bail bonds of Rs. 1,00,000/-(One Lakh) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge IVCum-Special Judge Excise, Bhojpur at Ara, in connection with Agion Bazar P.S. Case No. 24 of 2019.

The cash deposit of Rs. 1,00,000/- shall abide by the final outcome of the pending criminal case.
