The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 341, 323, 4448, 379, 504, 506, 458, 376 of the Indian Penal Code. As per the prosecution case, this petitioner entered in the house of informant and committed rape with her daughter. It is submitted on behalf of petitioner that F.I.R. has been lodged after a delay of five days without there being any plausible explanation. Petitioner is innocent and has been falsely implicated in this case due to the fact that uncle of the petitioner had lodged a case against father of informant and others, vide Baheri P.S. Case No. 91 of 2021.

However, learned A.P.P. for the State has opposed the prayer for anticipatory bail and submitted that petitioner is

Patna High Court CR. MISC. No.65835 of 2021(3) dt.12-07-2022 2/2 named in the F.I.R. and there is specific allegation against this petitioner that he committed rape with the daughter of informant.

Considering the aforesaid facts and circumstances as well as specific allegation against this petitioner, the prayer for anticipatory bail of petitioner is rejected.
