The petitioner seeks bail in a case under section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. There is direct allegation against the petitioner that he fired which hit on the chest of the son of the informant and the son of the informant died.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail in connection with Madanpur P.S. Case No. 139 of 2014, giving rise to Sessions Trial No. 05 of 2015/01 of 2015 pending in the court of the Additional Sessions Judge V, Aurangabad. This application for bail is, accordingly, rejected.
Since the petitioner is in jail since 13.08.2014,
Patna High Court Cr.Misc. No.18160 of 2015 (3) dt.06-07-2015 the trial court is directed to expedite the trial of the petitioner and conclude the same on day to day basis within one year from the date of receipt/production of a copy of this order. (Prabhat Kumar Jha, J) Amin/- U
