Public Prosecutor. The sole petitioner, who is in custody since 31.07.2016 in Lakhisarai (Ramgarh Chowk) P.S.

Case No.36/2016, G.R. no.96/2016 registered for the offence under Sections 341, 323, 504, 307, 406/34 of the Indian Penal Code and Section 27 of the Arms Act, has prayed for grant of bail. By way of referring to F.I.R. learned counsel for the petitioner submits that save and except the fact that the petitioner was present at the time of occurrence, there is no specific accusation of overt act against the petitioner. He submits that the petitioner is having clean antecedent. This fact has been stated in

Patna High Court Cr.Misc. No.40976 of 2016 (2) dt.03-10-2016 2/2 paragraph-3 of the petition.

Keeping in view the fact that there is no specific accusation against the petitioner, clean antecedent of the petitioner and period of custody, let the petitioner, namely, Sumit Kumar @ Samit Kumar be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai ( Ramgarh Chowk) P.S. Case No.36 of 2016, G.R. No.96 of 2016.
