This is a petition for grant of anticipatory bail for offence under Sections 406, 420 and 120B of the Penal Code.

The allegation is that the accused persons took Rs.3600/- on the assurance that it will be converted in Rs.10,000/- within six months and even a cheque of Rs.10,000/- was given in advance and it was also assured that after maturity the cheque may be encashed. The learned counsel for the petitioner submits that the petitioner has not been named in the First Information Report and he has not been named as a person to have cheated this informant rather during investigation it is submitted that it has come that the petitioner also runs a financial institution. However, it has been submitted that except this, no role has been attributed against the petitioner. It has been

Patna High Court Cr.Misc. No.38792 of 2014 (3) dt.23-04-2015 2/2 submitted that the accused persons, who have been named in this case, have been granted anticipatory bail by this Court in Cr. Misc. No. 6172 of 2013. Hence, having regard to the facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with the Barsoi P.S. Case No. 170 of 2012 to the satisfaction of the Chief Judicial Magistrate, Katihar, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
