JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-11-2016 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 02.05.2016 passed in Cri. Misc. No. 11764 of 2016, on the ground that the petitioner is suffering in custody since 14.08.2015, there is no eye-witness of the occurrence, in near further the trial is not likely to be concluded and, as such, the petitioner deserves sympathetic consideration, to which the learned APP seriously opposes by submitting that the petitioner was seen fleeing away from the house of the informant after committing crime and witnesses have also supported the same.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again

Patna High Court Cr.Misc. No.48910 of 2016 (2) dt.16-11-2016 2/2 prayer of the bail of the petitioner stands rejected. However, the learned trial Court is directed to expedite the trial and conclude the same as early as possible preferably within six months from the date of receipt/production of a copy of this order.
