In the present case, the petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No. 254 of 2017 registered for the alleged offences under Sections 302/120(B) of the Indian Penal Code and Section 27 of the Arms Act. Allegedly the father of the informant was murdered by the petitioner and other co-accused persons. The learned counsel for the petitioner submits that the F.I.R. has been registered against unknown and co-accused Chintu Kumar. This petitioner has nothing to do with the coaccused or his act. No.65831 of 2021(4) dt.28-06-2022 2/3 confessional statement of another co-accused namely Gobinda and the said co-accused has been granted bail by a Coordinate Bench vide 06.04.2022 passed in Criminal Misc. No. 71806 of 2021. Except the confessional statement of co-accused there is nothing on record against this petitioner who is in custody since 08.03.2021.

Learned A.P.P. for the State has opposed the prayer on behalf of the petitioner. The learned A.P.P. has submitted that the petitioner is having criminal antecedent and he is accused in a number of cases.

Having regard to the submissions made hereinabove and considering the fact that nothing substance is on record against his petitioner except the confessional statement of coaccused person and further considering the period of custody, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 254 of 2017, subject to the following conditions :

(i) The bail bond of the petitioner shall be accepted only after framing of charge, if not already framed.

(iii) The petitioner will remain present on each and every date fixed by the court below.
