The petitioner seeks bail in K. Nagar P.S. Case No. 34/2014, registered for the offences punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code. The father of the deceased alleged that his daughter Ansari Khatoon was married to Md. Israel about 13 years ago and she got two female child but her husband solemnized second marriage with Akhatari Khatoon and thereafter some quarrel took place. His daughter filed a case against her husband and the same is pending for last two years. The informant got information on 26.11.2013 that his daughter is missing. On 27.11.2013, the informant informed the police and during the course of search it
Patna High Court Cr.Misc. No.6627 of 2015 (3) dt.16-04-2015 2/2 came to know that a dead body of female was found in a field. It is submitted that there is no allegation against the petitioners, except the suspicion that the petitioners, being the brothers of the second wife of Md. Israel, might have killed his first wife.
It is submitted that during the course of investigation some of the witnesses disclosed that Md. Israel divorced his first wife and she developed illicit relation with one Ramesh Sah. Considering the aforesaid facts that there is no material against the petitioners, who happens to be brothers of the second wife of Md. Israel, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Purnea in connection with K.
