JUSTICE SUDHIR SINGH ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 467, 468, 471, 419, 420, 379 and 120B/34 of the Indian Penal Code.

Allegation is that an account in the name of District Welfare Officer was opened in Canara Bank but illegally through forged cheques Rs. 7,14,000/- was withdrawn from the said account.

Earlier bail application of the petitioner was rejected with an observation "at this stage". In the light of said observation, this is the second attempt for bail on behalf of petitioner. It has been submitted on behalf of petitioner that he is in custody since 16.9.2015. Chargesheet has been submitted against petitioner. Petitioner has been made accused due to mistake of fact. The name of father of petitioner and the name of father of the account holder did not tally. It is a case of misidentification.

Patna High Court Cr.Misc. No.47476 of 2016 (3) dt.07-12-2016 2/2 Other co-accused has been granted bail vide Cr. Misc. no. 35762 of 2016.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Shikhpura P.S. Case no. 64 of 2015.
