The petitioners seek bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (a), 41 and 47 of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 200 pouches each containing 200 ml of spiced country-made liquor were recovered from the possession of the petitioner no. 1, however, there was no recovery from the possession of petitioner no. 2.

Patna High Court Cr.Misc. No.39272 of 2017(2) dt.19-08-2017 2/2 Petitioners claims that the petitioner no. 2 is having clean antecedent, however, petitioner no. 1 is accused in Patrakar Nagar P.S. Case No. 171 of 2011 for offences under Section 279, 304(A) and 337 IPC and they are in custody since 09.06.2017.

Considering the facts and the circumstances of the case, the petitioners, above named are directed to be released on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Jamui in connection with Sono P.S. Case No. 120 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
