The petitioner seeks bail in a case registered under Sections 147, 148, 149, 342, 302, 120B/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons having armed with deadly weapons came and fired upon the informant's husband on his head, due to which her husband died. It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.04.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The allegation of assault by fire arms is against co-accused Tufani Yadav and Charpa Yadav. No allegation of assault is alleged against the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 3rd, Naugachia, District Bhagalpur in connection with Gopalpur (Rangra) P.S. case No.105 of 2019.
