JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the informant. The petitioner is not named in the first information report but in course of investigation, when further statement of the informant was recorded, he disclosed the name of the petitioner and others, expressing suspicion against the petitioner and some others on the ground that prior to the alleged occurrence, an altercation had taken place between the deceased persons and the petitioner as well as others. In course of investigation, the I.O. recorded the statement of one doctor, Upendra Kumar at paragraph-10 of the case diary and the aforesaid paragraph of the

Patna High Court Cr.Misc. No.2536 of 2015 (3) dt.17-04-2015 case diary, is very important and relevant in this case. The aforesaid Dr. Upendra Kumar stated that between the night of 18/19, the deceased Guletan was brought to his clinic by FIR named Babua and some others and after that, they left the clinic and in the next morning, the dead bodies of Guletan and one other were found.

Although witnesses stated the involvement of the petitioner in the alleged crime but except suspicion, there appearing to be nothing against the petitioner. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Cheriyabariyarpur P.S. Case No. 203 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Begusarai. (Hemant Kumar Srivastava, J) A.K.V./- U T
