The petitioner is accused in connection with Rajgir P.S. Case No. 163 of 2016 registered under sections 458 and 380 of the I.P.C. pending in the Court of A.C.J.M.-IV, Nalanda at Biharsharif.

It is alleged that petitioner along with two accused persons entered in the house of the informant and started assaulting and roped her and thereafter, took her ornaments and money and fled away.

Submission is that petitioner is not named in the F.I.R. and on the basis of suspicion, he has been made accused in this case.

Patna High Court Cr.Misc. No.49150 of 2016 (4) dt.02-02-2017 2/2 Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner has criminal antecedent and seizure list of stolen articles clearly shows the involvement of this petitioner in this case. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.

However, petitioner may renew his prayer for bail after framing of charge.
