JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in this case and thereafter, the tower location of mobile of the petitioner was collected and it was found that petitioner was present near the place of occurrence at the time of alleged occurrence. The coaccused was arrested and confessed his guilt disclosing this fact that petitioner had kept strict vigil over the activities at the time of alleged occurrence with an intent to facilitate the other culprits in committing the alleged crime. Except the aforesaid material, there appears to be nothing against the petitioner, who does not have any criminal antecedent which is evident from perusal of Para-3 of

Patna High Court Cr.Misc. No.2573 of 2015 (4) dt.17-04-2015 2/2 the petition.

Accordingly, above named, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate,1st class Daudnagar, Aurangabad in connection with Upahara P.S.Case No. 44 of 2014.
