The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 379, 411, 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent, not named in the FIR and has been falsely implicated in this case. He submits that the petitioner's name came in this case in course of investigation and his name confessed by the co-accused before the police which has no evidentiary value in the eye of law. He submits that the similarly situated co-accused has already been granted bail by a Bench of this Court vide order dated 05.12.2011 passed in Cr. Misc. No. 31388 of 2011. Learned APP for the State opposes the prayer for bail and submits that the petitioner has filed the present anticipatory bail application after delay of more than 11 years. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Nawada Town P.S.
