Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and Sections 25(1-b)a, 35, 27 of the Arms Act.
Petitioner is said to have opened fire on the informant, who appears to have sustained one injury on his right lower chest wall measuring 1"x1/2"x1/2" with blackening around. The doctor opined that aforesaid injury was looking like a gun shot injury. Moreover, opinion regarding the nature of aforesaid
Patna High Court Cr.Misc. No.36317 of 2016 (3) dt.10-11-2016 2/2 injury was kept reserved and even after completion of investigation, the investigating officer did not collect the complete injury report of informant. However, learned counsel appearing for the informant also failed to disclose the nature of injury of informant.
Submission on behalf of the petitioner is that there is case and counter case between the parties and as a matter of fact, it was a member of prosecution party, who had opened fire causing injury to informant.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram (T) P.S. Case No. 1341 of 2015.
