2. Petitioner seeks regular bail in connection with Kanti P. S. Case No. 16/2021 in a case registered for the offences punishable under Sections 272, 273, 120B of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act.

3. As per the prosecution case, 3640 litre illicit liquor was recovered from two different vehicles.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he has been made accused only on suspicion. Petitioner is neither driver nor owner of the vehicles in question and he is in custody since 24.07.2024.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Court-II, Muzaffarpur in connection with Kanti P.
