JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is languishing in jail custody since 2007-2016 in a case registered under Section-379 of the Indian Penal Code.
The first information report goes to show that the petitioner was driver of the truck bearing registration No. JH-02N2027 which had been used in committing the alleged crime. Learned counsel for the petitioner submits that even if, it assumed that the petitioner was driver of the aforesaid truck and some stolen ducts and cables were loaded on the truck of the petitioner, then also, the petitioner got loaded the aforesaid articles in good faith.

Hat P.S. Case No. 582 of 2013 to the satisfaction of learned Chief Judicial Magistrate, Purnea.
