JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-272, 273 of the Indian Penal Code and 47A of the Excise Act.
Twenty litres unripe sprit, kept in a plastic jar, is said to have been recovered from house of the petitioner, for which, petitioner is in jail custody since 26-06-2016. Moreover, petitioner was neither caught on the spot nor the aforesaid recovery was made in his presence. The petitioner does not have any criminal antecedent.
Accordingly, the petitioner named above, is
Patna High Court Cr.Misc. No.36976 of 2016 (2) dt.05-09-2016 2/2 directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Pipra Kothi P.S. Case No. 25 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran.
