JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that petitioner could be remanded in this case after 11 years of the occurrence and petitioner delayed his trial for such a long period, I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Session trial no. 344 of 2016/ 387 of 2016 arising out of Chand P.S.Case No. 58 of 2005, pending in the court of Vth Additional Sessions Judge, Kaimur at Bhabhua stands rejected.

However, learned court below is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within four months from the date of framing

Patna High Court Cr.Misc. No.41484 of 2016 (03) dt.04-10-2016 2/2 of charge and if the concerned court fails to conclude the trial of the petitioner within the aforesaid period, petitioner may renew his prayer for bail before the learned court below itself. (Hemant Kumar Srivastava, J) N.K/- U T
