JUSTICE PURNENDU SINGH ORAL ORDER 10-12-2025 Heard Mr. Bimlesh Kumar Pandey, learned counsel appearing on behalf of the petitioners; Mr. Krishna Kant Pandey, learned counsel for the O.P. No. 2 and Mr. Anant Kumar 1, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Mainatand P.S. Case No. 39 of 2025 registered for the offence punishable under Sections 137(2), 96, 352 and 351(2) of the Indian Penal Code.
3. As per the allegation made in the FIR, the petitioners along with co-accused Chandan Kumar, had allegedly kidnapped the minor daughter of the informant.

4. Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and have falsely been implicated in the present case. He further submitted that petitioners are father and brother of the main accused Chandan Kumar, against whom it has been alleged that with an intention to marry, he had kidnapped the minor daughter of the informant. He informs that victim in her statement recorded under Section 183 BNSS has given specific information that she on her own had eloped with the co-accused Chandan Kumar. On these grounds, petitioners seek to be released on pre-arrest bail.
5. Learned counsel for the O.P. No. 2 informs that the victim has performed marriage with the main accused Chandan Kumar and they are living together.
6. Considering the rival submissions made on behalf of the parties, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned District Court where the case is pending, in connection with Mainatand P.S. Case No. 39 of 2025, subject to the condition as laid down

7. The learned District Court is directed to verify the criminal antecedent of the petitioners as stated in paragraph no. 3 of the bail application.
