The petitioner seeks bail in Nanpur P.S. Case No. 12 of 2015, registered for the offence punishable under Section 395 of the Indian Penal Code.

It is submitted that the petitioner is not named in the FIR. Name of the petitioner has figured in the case in the confessional statement of Md. Asmat @ Imran. The petitioner has not been put on test identification parade. Co-accused Md. Asmat @ Imran and Md. Firoz have already been enlarged on bail.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Nanpur P.S. Case No. 12 of 2015.
