The F.I.R. has been registered for the offences punishable under Sections 364, 365, 379, 34 of the Indian Penal Code against three unknown persons.

Name of the petitioner has transpired during course of investigation in the confessional statement of co-accused Sanjeev Kumar. It is submitted that save & except confessional statement, there is no other material to show complicity of the petitioner in the aforesaid crime. Petitioner is in custody since 15.04.2021.

However, learned A.P.P. for the State opposed the bail petition and submitted that photograph of this petitioner was shown to one of the witness Dhanendra Patel, who identified him. Petitioner has got criminal antecedent also.

Patna High Court CR. MISC. No.66719 of 2021(3) dt.18-04-2022 2/2 Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
