The petitioner is languishing in custody since 10.04.2016 in connection with Sasaram (Town)P.S. Case No. 167 of 2016 for the offences instituted under Section 392 of the IPC. Later on, Sections 395 and 411 of the IPC were also added. The prosecution story, in brief, is that the informant alongwith two staff was in his medical agency shop. In the meanwhile, three miscreants entered into the shop and on the point of pistol, one miscreant took away Rs. 80,000/- from his cash counter and also looted away golden ring, mobile and damaged the connection of landline phone and computer. Thereafter they fled

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.04.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He has been made accused in the present case on the basis of confessional statement of co-accused. He has not been put on T.I. Parade. There is no recovery of any incriminating article from possession of the petitioner.
On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Rohtas at Sasaram in connection with Sasaram (Town) P.S. Case No. 167 of 2016.
