Petitioner being mother-in-law of the deceased is languishing in jail custody since 4.10.2014 in a case registered under section 304B/34 of the IPC and 3/ 4 of the D.P. Act. According to the prosecution case itself, after marriage, deceased went to her in-laws house where she gave birth to a child and after birth of child, so-called demand of dowry was made. No doubt, one Rahul Kumar, who happens to be cousin nephew of the deceased, claims himself to be eye-witness of the alleged occurrence and states that deceased along with two months old child were thrown in the well by the petitioner and husband of deceased due to non-fulfillment of illegal demand but paras 29 and 30 of the case diary reveals that when husband of deceased refused to permit her to go to her parental home, deceased committed suicide.
Patna High Court Cr.Misc. No.3246 of 2015 (3) dt.20-04-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Munger in Mufassil P.S.
