The petitioner seeks bail in connection with Kursakanta (Kuari O.P.) P.S. Case No. 107 of 2021 instituted for the offences under Section 30(a) of the Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 18.09.2021, charge-sheet has been submitted in the case and has got one antecedent. Learned counsel for the petitioner submits that allegation is of recovery of 260.700 litres of liquor from three motorcycles.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name came in

Patna High Court CR. MISC. No.66873 of 2021(2) dt.18-02-2022 2/2 the confessional statement of co-accused, Bechan Mandal which has no evidentiary value in the eyes of law.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 18.09.2021, charge-sheet has been submitted in the case and his name accused in the confessional statement of coaccused, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Araria in connection with Kursakanta (Kuari O.P.) P.S. Case No. (Satyavrat Verma, J) Rishi/- U T
