1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in Gandhi Maidan P. S. Case No.223 of 2021 registered for the offences punishable under Section 379 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that similarly situated co-accused Vicky Kumar had approached this Court seeking anticipatory bail by filing Cr. Misc. No.66272 of 2024 and the same was allowed by an order dated 23.10.2024. It is next submitted that petitioner is also similarly situated and thus, seeks anticipatory bail based on parity.

4. Learned A.P.P. Sri Chandra Bhushan Prasad opposes the anticipatory bail application and submits that Vicky

No.66934 of 2024(2) dt.23-10-2024 2/2 Kumar was granted the privilege of anticipatory bail on the ground that he had antecedent of one case, but then, from perusal of the criminal antecedent of the petitioner, it appears that he has antecedent of three cases of similar nature and allegation is of theft of motorcycle from Gate No.1 of Gandhi Maidan where it was parked.

5. Considering the submissions made by the learned A.P.P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

6. The prayer of the petitioner for anticipatory bail stands rejected accordingly.
