JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-05-2015 Both petitions arise out of Babubarhi P.S. Case No. 18 of 2014 registered under Sections-467, 468, 471, 409 & 120B of the Indian Penal in which, petitioners apprehends their arrest and accordingly, both the above-said petitions are being heard and disposed off by this common order.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Admittedly, the petitioner in Cr. Misc. No. 40155 of 2014 was headmaster whereas; the petitioner in Cr. Misc. No.
Patna High Court Cr.Misc. No.40155 of 2014 (3) dt.15-05-2015 2/2 40467 of 2014 was teacher in the concerned school at the relevant time and it is alleged that the petitioner in Cr. Misc. No. 40467 of 2014 withdrew his salary in connivance with the petitioner in Cr. Misc. No. 40155 of 2014 without attending the concerned school. The statements of witnesses recorded in course of investigation reveal that fake attendance was made in attendance register and except the aforesaid material, there appears to be nothing against the petitioners.
Accordingly, this anticipatory bail petition is allowed and it is ordered that let the petitioners named above, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Babubarhi P.S. Case No. 18 of 2014 to the satisfaction of Chief Judicial Magistrate, Madhubani subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
