The petitioner is facing prosecution in connection with Garkha P.S. Case 265 of 2016 registered for offence under Sections 147, 148, 149, 341, 323, 307, 504 and 427 of the Indian Penal Code as well as 27 of the Arms Act. The occurrence took place owing to land dispute between the parties for which the present case as well as a counter case vide annexure-2 has been registered for offence under Section 307 of Indian Penal Code. In the case at hand, the petitioner has is alleged to have fired which hit the lower part of the body of the injured (informant). In the counter case, the petitioner is the informant of the present case. In the counter case, it is stated that the informant has been released on bail by the court below. In this case, the

It is stated that injuries are not grievous. Petitioner is an Advocate.
Considering the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Saran at Chapra, in connection with Garkha P.S. Case No. 265 of 2016 with conditions (1) one of the bailors shall be close family members of the petitioner; (2) at the time of framing of charge, the petitioner shall himself present in court on the date fixed by the court below and in failure of his appearance on two consecutive dates, his bail bond shall be cancelled by he court below and (3) during the subsistence of privilege of bail, if the petitioner get involved in any other criminal case of identical nature the same shall be treated as breach of condition of bail and the trial court shall take steps for cancellation of his bail bond.
