Learned counsel for the petitioner submits that the petitioner is in custody since 15.05.2019, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that earlier the bail application of the petitioner was rejected vide order dated 17.06.2020 passed in Cr. Misc. No. 75618 of 2019. Learned counsel further submits that till date even the case has not been committed and as such the charges have not been framed and the petitioner has remained in custody for nearly three years as an under trial prisoner as such the petitioner deserves to be released on bail.

Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.66555 of 2021(2) dt.12-04-2022 2/2 bail of the petitioner.

Considering the period of custody of the petitioner and taking into consideration the submissions made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Shahkund (Sajour) P.S. Case No. 190 of 2018.
