2. The petitioner is apprehending his arrest in connection with Supaul P.S. Case No. 128 of 2021 dated 17.02.2021, registered for the offences punishable under Section 10 of Bihar Examination Act and Section 420 of the Indian Penal Code pending in the Court of learned C.J.M., Supaul.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the

Patna High Court CR. MISC. No.56453 of 2023(2) dt.15-09-2023 2/2 order, preferably, on the same day, without being prejudiced by this order considering this fact that the petitioner has got no criminal antecedent.
