The petitioner apprehends his arrest in connection with Aurangabad Town P.S. Case no. 308 of 2017, registered under Sections 467, 471, 420, 409, 406/34 of the Indian Penal Code.
Petitioner happens to be the then District Manager, BSFC Aurangabad, who is said to have usurped empty Gunny Bales during the financial year 2011-12, 2012-13 and 2013-14 by manipulating forged documents in association with other accused persons.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.53309 of 2018(2) dt.12-12-2018 2/2 petitioner that the petitioner was posted as District Manager of the BSFC only for brief spell of time from 25.02.2014 to 29.09.2014 and there is no discrepancy regarding storage and delivery of the empty Gunny Bales in the said period and moreover no case has been lodged by any official of BSFC against the petitioner. Petitioner has already filed representation before the A.D.G. of Police C.I.D., Bihar giving clear existing data based on the official record and similarly situated several accused persons have been enlarged on anticipatory bail by different co-ordinate Benches of this Court.
In the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case no. 308 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
