JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-11-2022 The present petition has been filed seeking the following reliefs :- "(i) For issuance of an appropriate writ(s)/ order(s)/ directions (s) in the nature of mandamus for a direction to the concerned state respondents to remove encroachment from Jhanda Chowk, Birauli Bazar, Circle-Rupauli, District-Purnia where the private respondent

Patna High Court CWJC No.19590 of 2021(2) dt.03-11-2022 2/2 nos. 7 to 11 have encroached the public land. (ii) For issuance of an appropriate writ(s)/ order(s)/ direction(s) in the nature of mandamus for a direction to the concerned respondents to remove the said encroachment from the public land and to clear the said Jhanda Chowk in Birauli Bazar, Purnia where Flag Hoisting Ceremony is conducted on the occasion of Independence Day and Republic Day."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Rupauli, Purnia for redressal of his aforesaid grievances. Liberty so sought, is granted.

It is needless to state that in case, the petitioner approaches the Circle Officer, Rupauli, Purnia by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith. The writ petition stands disposed off on the aforesaid terms.
