HONOURABLE MR JUSTICE RAJIV ROY ORAL ORDER 15-09-2023 Learned counsel for the petitioners submits that during pendency of the case, petitioner No 2 Triveni Yadav has already been arrested and, as such, the order against him has become infructuous.
2 This application, in so far as petitioner No 2 Triveni Yadav is concerned, is dismissed as infructuous. 3 Heard the parties.
4 On the undertaking of the learned counsel for the petitioners, that they will be paying Rs 10,000/- each to the informant, the same was recorded in the order dated 06.02.2023 passed in Cr Misc No 57921 of 2022.
Patna High Court CR. MISC. No.62926 of 2023(2) dt.15-09-2023 2/2 5 Learned counsel for the petitioner submits that though petitioner No 1 Dilip Yadav is ready to pay the amount in view of the fact that others could not be contacted, he also could not come out of the jail.
6 In that view of the matter, the order dated 06.02.2023 passed by this Court in Cr Misc No 57921 of 2022 stands modified to the following extent:
7 Let petitioner No 1 Dilip Yadav, in the event of his arrest or surrender, be released on bail subject to payment of Rs 10,000/- by him to the informant by demand draft. 8 The order dated 06.02.2023 passed by this Court in Cr Misc No 57921 of 2022 stands modified to the extent, as indicated above.
9 The time of surrender of petitioner No 1 Dilip Yadav is extended for another four weeks from today. 10 This application, in so far as petitioner No 1 Dilip Yadav is concerned, stands allowed.
