JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 30-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in a case registered for the offence punishable under section 323, 353, 307 of the Indian Penal Code and section 25(1-b)a, 26, 27 and 35 of the Arms Act.
On getting confidential information regarding assemblage of anti social elements having engaged in carrying/supplying/dealing with illegal fire arms, the police conducted raid and during course thereof two persons, namely, Sushil Mahto and Ajit Mahto (petitioner) were apprehended while remaining succeeded in their escape and during course thereof, also fired at the police. No.19031 of 2015 (4) dt.30-06-2015 from possession of Suresh Mahto one loaded pistol from his physical possession while from a bag five country made pistol along with two magazines were seized while from possession of the petitioner one country made loaded pistol along with five cartridges were seized. As per paragraph 3 of the petition, the petitioner has got no criminal antecedent and is in custody since 27.10.2014.
Accordingly, petitioner Ajeet Mahto is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rosera, Samastipur in connection with Bithan P.S. Case No. 102 of 2014. (Aditya Kumar Trivedi, J) Amin/- U
