JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and the learned A.P.P. for the State.
The petitioner is accused in connection with Complaint Case No. 4028 of 2012 registered under Section 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Learned counsel for the petitioner submits that petitioner happens to be the husband of Archna Kumari, opposite party no. 2 and now both are leading conjugal life at present.
Patna High Court Cr.Misc. No.38205 of 2014 (2) dt.01-04-2015 Learned counsel for the opposite party no. 2 submits that misunderstanding between the petitioner and his wife, opposite party no. 2, has been resolved and both are also residing together as husband and wife.
Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Complaint Case No. 4028 of 2012, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
