JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew the prayer of bail, which was earlier twice rejected vide order dated 17.02.2017 passed in Cr. Misc. No. 1971 of 2017, on the ground that the petitioner is in custody since 19.11.2016, co-accused Prakash Kumar and Nitiesh Kumar have already been allowed bail by the Court below itself and the case of the petitioner is on similar footing, to which the learned A.P.P. opposes by pointing out the statement of the sister of the informant recorded under Section 164 of the Cr.P.C In the facts and circumstances stated above, considering the custody of the petitioner now, the petitioner is

No.44160 of 2017 (2) dt.20-09-2017 2/2 also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 531 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
