The petitioner, being the husband of the complainant, is languishing in jail since 18.04.2016 in a case registered under Sections 498A of the Indian Penal Code and 4 of the Dowry Prohibition Act.
The basic accusation is of torture for non-fulfillment of dowry demand.
it is submitted by the learned counsel for the petitioner that the petitioner was granted bail in Bail Application No. 1060 of 2013 till 08.01.2014 with the condition that if the petitioner will not keep his wife and children, then, the bail will be cancelled and in pursuance to that the bail bond of the petitioner was cancelled and consequently the petitioner surrendered and submits that the complainant is violating the undertaking given before the learned Court below.
Considering the aforesaid facts and circumstances, let
Patna High Court Cr.Misc. No.36254 of 2016 (2) dt.23-08-2016 the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Complaint Case No. 1510C of 2012 to the satisfaction of the Subdivisional Judicial Magistrate, Khagaria.
