The petitioner seeks bail in a case instituted under Section 366A of the Indian Penal Code.

The prosecution case, in brief, is that the petitioner along with others kidnapped the minor daughter of the informant by a black coloured Scorpio vehicle.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.06.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The date of occurrence was 25.09.2015. The F.I.R. has been instituted on 19.10.2015. The

Patna High Court Cr.Misc. No.42188 of 2016 (2) dt.03-10-2016 2/2 delay has not been explained. The victim is said to have been recovered. No inducement or sexual abuse is alleged against the petitioner by the victim. It is a case of love affair between the petitioner and the victim.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (M) P.S. Case No. 1185 of 2015.
