Petitioner seeks bail in Biharsharif P.S. Case No. 10 of 2017 for the offence punishable under Sections 147, 148, 149, 341, 323, 325, 307, 353, 333, 379, 427, 436 of the Indian Penal Code, Section 27 of the Arms Act and Section 3/4 of Prevention of Damage of Public Property Act and Sections 145, 146, 147, 150 and 153 of the Railway Act.

Allegation against the petitioner is that about 1000 to 1200 unknown persons assembled at Biharsharif Railway Station to protest against the Government, and thereafter it became violent and damaged Railway properties. It has been submitted on behalf of the petitioner that for the same incident two FIRs have been registered and except

Patna High Court Cr.Misc. No.49063 of 2017(2) dt.18-10-2017 2/2 these two cases petitioner has got no criminal antecedent and is not involved in any other case. It has further been submitted that similarly situated co-accused persons have been granted bail by a co-ordinate bench of this Court vide order dated 12.09.2017 passed in Criminal Miscellaneous No. 42158 of 2017. Petitioner is in custody since 11.07.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Railway Patna, in connection with G.R.P. Biharsharif P.S. Case No. 10 of 2017.
