The petitioner seeks bail in connection with Sasaram Muffasil P.S. Case No. 245 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 04.07.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 259.2 litres of liquor from a Mahindra pick-up van.

Learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the van but had

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 04.07.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Excise, Rohtas at Sasaram in connection with Sasaram Muffasil P.S.
