JUSTICE SUDHIR SINGH ORAL ORDER 10-01-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are languishing in custody since 10.07.2016 in connection with Kishanganj Mahila P.S. Case No. 28 of 2016 for the offences instituted under Sections 370, 372,373, 120(B) of the IPC, 3, 4, 5 of the Immoral Traffic (Prevention) Act and Sections 8 and 12 of the POCSO Act.

The prosecution story, in brief, is that the informant raided the house of Neelam Khatoon and found two girls in objectionable position with two different persons, namely, Dilnawaj and petitioner no. 2. From the house of Sajana Khatoon, Amana Khatoon was recovered in objectionable position with

Patna High Court Cr.Misc. No.51563 of 2016 (3) dt.10-01-2017 2/2 Afsar. The victim girls have stated that Neelam Khatoon and Sajana Khatoon were running brothel house with the help of the petitioners. Petitioner no. 2 is also a flesh broker arranging the customer for brothel house.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 10.07.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioners. They have got no criminal antecedent. They have falsely been implicated in the present case. The victim girls have denied the allegations made in the FIR.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J. Ist-cumSpecial Judge, Kishanganj, in connection with Kishanganj Mahila P.S. Case No. 28 of 2016.
